NEII Shares OSHA Civil Penalty and Proposed Rules Updates

The National Elevator Industry, Inc. (NEII) recently shared information from the U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) about increased civil penalty fines and a proposed rule for reporting injuries or illnesses. Based on cost-of-living adjustments for 2023, OSHA has increased maximum financial penalties for serious and other-than-serious violations from US$14,502 to US$15,625 per violation. The maximum penalty for “willful or repeated” violations increases from US$145,027 to US$156,259 per violation. Published on March 30, 2022, OSHA’s proposed Improve Tracking of Workplace Injuries and Illnesses rule states that establishments in certain high-hazard industries with 20-plus employees continue to electronically submit Form 300A Annual Summary once a year to OSHA. Establishments in certain high-hazard industries with more than 100 employees are also required to submit Form 300 Log and Form 301 Incident Report Information once a year to OSHA. All forms are due to OSHA by March 2, 2023. The forms and further information may be found here.
